I definitely think the SGS3 is in trouble, but before they can file anything Samsung is probably quickly working on a fix just in case the inevitable happens.
It's going to take them a few months to get all the paper work processed etc.

Anything apple brings out will still run ios and still be tied to itunes therefore wont ever beat a fast android device for me.

GS3 injunction
First, the injunction obtained was a preliminary injunction based on a utility patent related to the universal search on the gnex. Somehow, apple was able to prove that they would be "irreparably harmed" absent an injunction based on this one patent. I still don't know how this is possible because it involves showing that people will buy the Gnex over the iphone because of this one feature.
Second, since it is a preliminary injunction based on a software element, all samsung has to do is change the disputed software element slightly. This is what allowed them to resume selling the SGSII in europe, and I believe the galaxy tab but I could be wrong. Once the change is implemented, voila, injunction pending final court decision.
Samsung, if they were smart, could very easily fix this situation by rolling out a software update. Also, I believe the judge said that this would clog an already over crowded docket, and this should be addressed at their trial date at the end of july. i guess if anything were to happen, it'd have to be after july 30th anyways
I think its interesting to note that apple has very little design patents succeeding on the merits, and really just minuscule utility patents for things like the lock screen and universal search. And I don't believe that's the reason any of US actually buy these phones.
I'm interested to hear other's thoughts on this, too

It's not just the design or design at all. That was for the Galaxy Tab and SGS1. It's the software and how we open up links with different apps, etc.
HTC already lost that one.

Apple's not going after Samsung or HTC per se, their after Google and Android in general. Since Google doesn’t produce their own h/w, Apple’s going after their partners that do. The injunction they just won is based on a feature integral to Android and with a victory (preliminary, it could still be overturned at trial and appeal after that) there's nothing stopping them from quickly applying the same argument to just about every Android device produced. I fully expect they will and of all the targets out there I can’t think of a better one than the SGS3. Second would be killing the Nexus 7 before it gets a chance to launch. HTC seems to be the weakest Gazelle so they may start there to get a few more notches in their belt before going after Samsung again. Sad really. All of Apple’s victories still won’t make me buy their products. I’d get a Windows phone if that was the only other option.
Samsung's different than the other manufacturer’s Apple's going after because of the "slavish copying" thing. Clearly the SGS1 and early G-Tab's were influenced by Apple's design. There’s a good chance that’ll get thrown out at one or more trials (or appeals) though based on "prior art;" meaning Apple got the patent but on designs that are document to have preceded theirs. The SGS3 is safe because of the "designed by lawyers" thing.

Returned the Note :-/

Headed out on vacation for the next week, so had to make a decision before my 30 day window was up.
Basically, I went with a larger screen for media related reasons (video, images etc), and the black-crush issue became a deal breaker for now. I think I'll sit on my crappy old iphone 3g for another month or so and revisit the Note or perhaps the the HTC onex. Hopefully the note will see ICS before too long and it'll fix some of the graphics issue i've been noticing.
That being said, I've got a couple cases that I will no longer need, they can be viewed in my review post of them in the review section. If you'd like them let me know...i'd accept cost of shipping plus beer money

It does disturb me that the one x has no sd slot and that the battery is not removable

I thought the same thing when I saw this. That would be a trend I'd never support. Batteries get weaker with time and it would be very inconvenient to send it off to be replaced. I hope this is just a rumor.

I don't know if you'd even consider an unsubsidized device. But if you would, the international Note (GT-N7000) is a big improvement over the AT&T Note. This is an educated personal testimony, as I have owned both devices. As for battery issues (and this applies to both the N7000 & the I717), 99% of the issues I've encountered have been caused by software. Google Maps, certain kernels, and certain root-enabled apps can cause perpetual, long-lasting wakelocks when the device should be in deep sleep. This seriously impacts battery life. However, once these issues are addressed, the Note finds it's battery life on par with the iPhone 4 & iPhone 4S.
I'm not trying to get into an Exynos versus Snapdragon debate. I'm simply making observations about the two devices' respective benchmark results, and their real-world everyday performance. Whether these differences are a result of the change in SoC, or something else entirely, is a discussion best had in another thread. For the purposes of this thread though, the international Note would serve you much better, and offers a much larger development community (for the moment; anything can change).
As far as the One X is concerned, it's another prime example of AT&T neutering a device to ensure LTE compatibility. If you think this is an acceptable trade-off because the altered device allows you to connect to AT&T's LTE network, consider this. AT&T doesn't care if you get 40Mbps or 1Mbps downstream. Their goal is to get devices off of their congested HSPA(+) network and onto their LTE network. In the process, they can tout it as a major upgrade designed to give YOU better service. The truth is that this "upgrade" wasn't a decision made to compete with big red; it was a necessary move to relieve the stress on their HSPA(+) network before it collapsed.
So, next time you go shopping for a phone to use with good ole' Ma Bell, consider what the device can do for YOU... not them.

No one phone is perfect, I hace owned more than 20 phones In the past few years and every phone I have had all have had drawbacks. What would be the incentive for a carrier to put out a perfect device when they rely on the revenue from phone sales? And everyone is different so everyone has there on perception of what perfect is. Me I couldnt have an Iphone as my daily driver because for one the screen is too tiny and two the iphone makes simple things much harder like creating a ringtone. But what I like about the Iphone is the many apps it has that Andriod still doesnt like Family fued.

Good post. I own both and am keeping both. They have different strengths, one is updates and unlocked the other get access to the LTE network which is excellent in the area where I live. One other thing is you get 5GB on the LTE unlimited plan for $30 opposed to 3GB on the HSPA plan before throttling. I have not seen any battery issues on either.
I really like the looks and specs of the HTC One XL but no SD crd and the battery thing bother me. I think it is 16GB or it 32GB internal memory? I just do not get that...Just my .02 cents.

Really? Do you even own one? Maybe you just don't know how to use it. My note works just fine with Gingerbread. It will probably be better with ICS, but it's not a joke without it. Considering the fact that we'll have ICS within the next few months, it's hardly a deal breaker even if you somehow can't stand to use the phone without the newest version of Android.

So, has anyone seen this? I hope Steve would be proud. This temp ban is ridiculous. Glad most of the devs for their hands on the one x, but block the new evo from even being released is going too far. I hate apple....

Yeah, pretty crazy. Too bad HTC doesn't have the legal heavy weight that Samsung has, or they would have been able to work something out. Apple sucks. Shutting down imports due to "pinch to zoom" or something equally rediculous.

its for clicking links in the text app. If you're running sense 4 go ahead and try it.. the hyperlinks and phone numbers are blue but clicking them does nothing. htc removed this because of apples bull**** patent

Yikes. I don't care for Apple personally, but I certainly don't wish death upon anyone.
If they really have patents on their technology, then they are doing the right thing by protecting their intellectual property. You just can't go around stealing other peoples stuff. I'm not saying HTC or Samsung or anyone else stole anything, just saying that IF they did - then they are facing their consequences.
The Patent War has gotten out of control with ALL the manufactures. Just seems this is the first that has actually stopped a device in its tracks. All this patent stuff is BS I would hate having the job of making sure a device doesn't infringe on one of Apples, Samsungs, Motorola, Googles, etc's patents. I would be willing to be that just about any device would infringe on some patented somewhere.
BTW I'm currently Patenting how I tie my shoes SO WATCH OUT..

It has gotten out of control. Something so minor should not be enough to block a shipment. Plus, that is a feature BUILT into Android, so they should not be after HTC but Google for that. I think devices that have skins can be attacked more because they added those patent violating features themselves vs. just building from google's source.

The patent they are talking about was applied for back in 1996 and granted in 1999. It is for clicking on a recognizable text string and bringing up a menu or performing a UI action. So, yes, clicking on a telephone number will no longer bring up the dialer, or clicking on an email address will not bring up the email app, etc. Which I think is ****ing bull****. It's common sense that when I click on a telephone number it brings up the dialer. Who wouldnt think of that? I didnt think things that were blatantly obvious were patentable. But I guess if you're crApple you can get anything patented.

This patent crap has gotten out of control. This is basically how computers work.
Imagine on your home computer, clicking on a link in xda and it doesn't open, just highlights it, then you have to copy and paste to go to that page.
Why would apple be given a patent for this? Its ridiculous and HTC has ALREADY removed the feature from their phones so the fact that they are still blocking them is asinine.

Oh I agree, but that is for the courts to decide. I think it needs to be more in-depth. Like prove that the programming code was stolen or something. Not just that the end result is the same. Kind of like prescription drugs. There are the brand names that have the rights to it, and then there are generics that are the same thing but branded differently.

Yes this may never work, but currently at the end of my shift at work, and I started thinking what would really show people what's going on behind the scenes with Apple suing HTC and Samsung. And this is the idea that I came up with, with the idea that it probably would never work, but hey its just a thought lol.
We've seen HTC comparing itself to Samsungs GSIII, just trying to compare itself. What if HTC and Samsung did it together with Google as the head supporter of Android, with a headline of something around, "Apple's run scared, attempting to ban these phones from you." Or "Meet the phones that Apple is terrified off..." Something in that sense to stir up curiousity and interest in. And on my mind, YMMV, I picture the OG EVO commercials with the Andrioids flying around the phone and showing it off with quotes from reviews.
But in the end, a for more info go to here, to show the potential customer what is going on since none of Apple's lawsuits are very big in the news unfortunately.
Obviously HTC and Sammy fans don't get along too well, but the Android OEMS seriously need to stick together for some time if they're ever going to have a chance if Apple keeps chipping away at them with court.
Reminder, this is just my personal opinion, but please share what you think of it. Or what you would add / change because I'm curious of this would ever be a true way to really give Apple some SERIOUSLY BAD PR, or if I'm just some nut case, who needs to get a job with daytime hours lol.

I work nights as well and I sometimes wonder if I am crazy bc my ideas make so much sense. I really like your idea. But any revenge on apple right now seems good to me.
Apple will always have their hardcore followers. No matter how much better my EVO LTE is the hardcore apple-ites will say Apple has better blah blah blah. And they will inevitably say "that's the phone that violated all the apple patents!" *snarl/*

You know the iPhone's use of google maps generates 40% of Google's income? And now that Apple is deciding to make its own map app to replace Google maps as the default in iPhone it seems like an all out break in the companies.
Apple isn't innovating anymore, all they're doing is filing stupid patents and suing. They'll probably win because they are on top and have the $ to pay lawyers where other companies don't.

I don't know what the percentage is but I bet it's a good amount, much more than 2% but no where near 40%.

The first article I read did not make it abundantly clear what part of google it was. They are just estimates too. Because even tho we are talking about iPhone users they will still be able to figure out how to use Google maps

I agree, I'm just saying it's going to sting a bit at Google. Hopefully it might help them get on the manufacturers and carriers a bit more to make sure they're selling quality products, I love Android but some of the stuff that gets put out there is absolute crap.
I know this thread has gotten off topic so I say to the OP, that might help if Google were to advertize. They make almost all their money off of ads but don't advertize themselves. The carriers do advertize phones a bit but they're more interested in selling you on their network than a specific phone. Not to mention the fact 3 of the 4 national carriers sell the iPhone so they wouldn't put down one of their own products.

Lol at least someone understands where I'm coming from. I doubt this will ever work but it was just an idea at the time.
But overall, I feel Google needs to help the OEMs stick together, for some amount of time, just to make it harder for Apple to try to make its dream of shutting Android down. Yes it would be hard, but on their current path, they may get their chance.
I laughed at some of the comments, but I guess the question I was trying to get around to ask,
Do you think google and the OEMs should make commercials with Google as the headliner to tell the world what Apple is suing about? I think if the overall general public knew, besides us tech enthusiasts , maybe people would see Apple for who they really are...

I agree, that's why I never suggested the carrier's to make the commercial because they don't want to have conflicts I suspect, and they only care to sell, regardless the product.

This is actually what I've been hoping would happen for quite a while. It's much easier to pick them off one by one than to attack a united front. Unfortunately the all-mighty (dollar, euro, whatever) always wins out. If the manufacturers and Google could put aside their differences and come together and attack Apple, I think Apple would be forced to back down. For the first time in 4 years Android's world-wide usage dropped last quarter. It only dropped about 0.6% (from, I think, 51% to 50.4%) but a drop none the less. Symbian had over 50% of the market 4yrs ago, now it's dead. "Those that fail to learn from history, are doomed to repeat it" -Winston Churchill

Normally, I agree with you. If HTC starts willy-nilly suing Apple over ridiculous things then yeah, they're no better. However this was a counterclaim against a specific lawsuit that Apple filed against HTC. Basically it's a counterclaim for the court to "take back" what they first said. If indeed the article is correct about it being a counter claim, that is.

I don't take issue with what HTC is doing. I just find it hilarious how XDA users find it to be acceptable that HTC is responding with a lawsuit, seeing as a lawsuit started this whole thing.
I note with interest the top post of this page; "i hope Android takes over iOS".
So, we want competition, but we want the competition to be gone. We don't want Apple fighting the battle with lawsuits, we want the battle to be fought with innovation and good ideas, but when HTC fights with lawsuits, we applaud them as though it's some sort of "revenge". We demonize iOS but fail to realize we wouldn't have Android the way it is without Apple.

It's a reap what you sow thing, Apple is now getting a taste.
You seem to forget most of us here were affected by Apple's ridiculous injunction, mid-purchase. So yeah, when they're getting theirs, don't sue me for smiling about it.
I'm hoping to see some end to it .vs this never ending litigation.

That's great and all. I'm glad that you feel a bit of vengence for a slight delay in getting your device.
You'll just have to excuse me if I don't take you seriously if one minute you're happy about litigation when it's against Apple but the next minute when it's against HTC you're all up in arms about patent litigation.

If samsung makes it with a little better specs and maybe an anoled screen I cannot see why they shouldn't make a mega 2 as they had good success with this mega..but this mega is awesome already and it can only improve if a mega 2 does happen to come out. ..but only time will tell.

This phone will never get the respect it deserves because of the mid-range specs. People will never know until they actually play with one :/

Exactly. Probably the first smartphone which disproves how specs on paper can be misleading and not tell the whole story about actual, discernable performance.
My Mega is just as snappy as my former S4.
Sadly, we may or may not ever see another here in the US. However, I'm sure that in a year or so, we will be talking about flexible displays anyway so...

This phone is a sleeper hit. I think there will be a Mega 2 next year.
I think there would likely be a mega 2. Samsung has to keep producing not only high end but also midrange phones to remain competitive.

I hope so, but then we also have to hope that it comes again to AT&T. I'm just afraid that AT&T may not be selling enough of them to warrant a second one in their lineup.
Again, this is just speculative paranoia, but you never know and we know how much is going to change in a year or more.

Lets remember whilst we know the specs and what they me average joe doesent know the diff between snapdragon this or exynos that. 8t wont sell well compared to the others purely because its too big for the majority of users most people have called it a tablet when they seen it. So anyone walking into the shop and see this next to normal phones they will probably stray away from it. Unlike peeps like us who do believe bigger is better

i think yes, we will see but not better than what we have already now. Samsung released this mega in rush without big announcement before, it was in exact time when Huawei released their ascend mate. also the development for this device i don't think it will run good since Samsung don't want that.
Samsung releasing some hybrid devices only to exam the market from our pockets and to say we are here then they kill these devices and kill the people who screwed and owned them. exactly as same what happened for Galaxy tab 7.7 which did not repeated and did not get any update or custom roms for more than a year.
Their loss, my gain. Maybe I should buy 2 for when this one dies. Although that doesn't look like any time soon AT ALL. lol

VERY true, up here in BC, Canada, I have only seen one person throughout my university campus with a Mega, everyone else is rocking a stupid iphone (dont understand the sillyness of one), I've seen only a handful of windows phones, and 2 Bberry's
Still saving up my pennies so I can get a Mega, the bad thing is the limited dual-core inside of it. It isn't BAD but a quad-core would make the phone way better. I love large phones.
