So I think I got swindled by AT&T... - AT&T HTC One (M7)

Ok about a month ago, I wanted to switch from T-Mobile because the rural coverage was pretty garbage. Edge speed was so slow, it would not load a single page.
I walked into the AT&T store with my unlocked HTC One, and wanted to sign up for service. At first they were cool with it, and then the balked... "If you trade in this phone and pay an additional $26, you can have the black one which is guaranteed to work on this network". Now, I was ANIMATE at the time about not signing a 2 year contract. I brought my own phone, so there was NO REASON to sign up. At no point did he indicate that I was required to sign up for a 2 year contract to receive this black phone, when I just traded in the exact same phone in perfect condition which was only 2 weeks old.
After I got my first bill, I was on the website checking out my features. It says I am eligible for upgrade in 2015... meaning, I am on a 2 year agreement. I did NOT want to be on any agreement like this, so I need to know what my options are.

EDIT/UPDATE: This was an authorized dealer, not an AT&T corporate store. I honestly did not know they were different - they look exactly the same. Either way, I got a refund, and was allowed to keep the phone even though I canceled service immediately. I went back to T-Mobile as they were always pretty awesome (just the coverage in rural areas is still going to burn).

Have you called anyone at AT&T to verify your suspicion?

Yea, you got taken to the cleaners on that one.
Your only option of getting out of the contract is to return the device and cancel service before the trial period ends. That means porting out to save your number if you came from T-Mobile with the line.
As far as getting your old device back... well, good luck:cyclops:
Was it unethical by AT&T, yes.
However, you were a bit gullible there, the portion of trading in your phone was a HUGE red flag:silly:
You never get an AT&T device subsidized without ending up in contract, period.
The point made about even exchange is simply mute.. When taking advantage of the trade in, you only get trade in value, not the $600+ MSRP. And the trade in value 'may' have cancelled out the AT&T branded device, however, you still got taken to the cleaners on this deal.

The sales people in stores get paid by signing up people to contracts. I don't think it was At&t as a whole that screwed you but that particular salesperson F'd you good to get paid.
Just check your paperwork and make sure you didn't sign anything showing a contract. Your best bet is to raise holy hell in the store with the manager and single out this salesperson. If that doesn't work move on to corporate. Good luck.

Now you say you were animate about bot signing up for a contract. Does that mean you informed the sales rep that you weren't interested in a contract? If so then yes, the sales rep screwed you hard for not explaining that you would be entering a 2 year agreement if you traded for the black one.
However, you should have asked more questions about the deal to get a better understanding. But it does sound like the guy was trying to get you on a contract without you knowing, seeing that he tricked you into it by offering a simple color change.
If this was less than 14 days ago go into the store and raise hell on earth, you will garuanteed be able to return the phone. As for getting your old phone back, I'm sure you signed something about it saying all trade ins are final. If it's been over 14 days....good luck. Trying to return a phone after that to AT&T is near impossible..good luck!

The AT&T store admitted guilt to me, however, they said they could do nothing since I am past the 14 day return policy. Basically the guy had me sign a 2 year contract while masking it as a phone SWAP and not a subsidy purchase.
So ya, to the above posters - AT&T was at fault. The credited my account with the value of the phone, minus the 2 year agreement price.

Everybody knows that when you receive a device at a lower price = conract. You do understand that the contract is what gets them their money back that they lost on the phone.
Do you honestly think they would stay in business if they did what they did for OP every time?
OP ya blew it, don't go blaming that sales rep. He knows he is right, and if you have ever worked in customer service you know that arguing with the customer is a waste of time.

I won't go blaming the sales rep who was fired for doing this to multiple customers in the last 2 months. Gotcha. Ok buddy You know everything. He was masking a 2 years subsidy with a phone swap, claiming the phones wouldnt work on AT&T. When a sales rep says its a swap and would not require a 2 year contract, you tend to believe him. The phones worked fine on AT&T, and he was just cashing commission checks at the expense of the customers. A few people figured it out in the 14 day return period, but I did not think to look at my bill.

Hell no you don't. A phone swap pretty much implies he shouldn't be getting a contract. Why would someone think "oh if I give them my phone for a phone gaurenteed to work on this network, esentially buying it at full price, it's a contract?" Some people here need to not be such jerks about this.

What would you do...if you suspect someone stealing?

Ok.....heres the deal. About 3 weeks ago i saw a ad on craigslist about a epic touch for sale. I use Textplus App when I text someone on Craigslist...but anyways, i texted the person to inquire about the phone.. He said he was a manager at the Sprint Kiosk in the mall down the street from my job. He said that he was selling the phone for $500. I was like, thats full price. So I declined and took my business elsewhere.
About a week later i see an add in Craigslist from the same person, this time selling a iphone 4. I use my sister's phone to send the guy a text about the iphone 4. Again he says its brand new and still in its wrappings and he's selling it for $400. I passed again...
So last Friday, i see another ad on Craigslist for a Epic Touch, brand new and sealed. I make contact with the person, via regular text. Its the same person as before. He tells me that he's selling the Touch for $500 or willing to trade it for a good computer.
I offered him a laptop or two phones. He accepted the offer but after a couple hours, i contacted him to let him know i had to think about it.
Yesterday he texted me and now says he has a brand new Iphone 4s, wrapped and seal and that he can get me any color i want. He told me he'll sale it to me for $650 or my laptop, one of my phones plus $150...i said, hell no. Thats too much to give away. I then tried to call his bluff. I told him to text me a copy of the receipt showing he paid $650+ for the phone. He said that he didnt have a receipt and that it was a direct ship to his job (the sprint kiosk). He said that the order receipt doesnt have his name nor a price on it. I then told him that i noticed that he was selling a new phone almost every week and selling them for full retail. He claimed that he has a family plan and that since he's a sprint employee, he gets phones for the 2 year price.
My guess is that he's stealing the phones and then selling them. I find it strange that someone has a different high end phone every week and brand new at that.
What do you all guess?

I honestly think he stealing them, because I use to work for corporate Sprint and nowhere would I be able to get so many phones that quick, and people from KIOSK usually steal stuff I met this one guy who was selling batteries their lol

I'd say if your worried about it then make a call to Sprint and report what info you have. Then it will be up to them to look into it. If they don't, you did your part and Sprint can only blame themselves.
if it's a corporate kiosk he could get fired for that whether he bought them legitimately or not. our employment agreement says we can't sell phones at all as it's a conflict of interest since you would be competing with the company you work for. most of the kiosks that are left are 3rd party but i'm sure they have a similar agreement

I see people on craigslist advertising phones all the time for cheap but when you click on it its salesmen advertising you to their stores. in my company this is not allowed you will get fired even though they aren't stealing its something we arent allowed to do

Maybe you are but eventually he will get caught if he is doing wrong. There is something called doing inventory we have fired several people due to doing inventory checks on phones and they wouldn't stop knowing we do this until they get caught

I would still call Sprint and have them transfer you to the right department and have them investigate, try HR - Human Resources. BE SURE TO CALL AND HAVE THEM INVESTIGATE!!! Ask if they can call you back and let you know what the story is. Good luck!!! Make sure to call, because this will make prices go up if he is stealing!!!

First off bro, don't mean sound rude or anything cause that ain't me...but if something doesn't seem right to a person, they normally stay away...no matter how good the deal may be. I definitely don't need the police knocking at my door saying I received stolen property or sprint contacting me telling me the phone I have was stolen....
Also, remember he texted me this past time about the iphone...I didn't contact him. In addition, I don't think i NEED cold hard evidence...this isn't "The Peoples Court"...lol. But I do feel that maybe Sprint or whomever should look into the matter...

I'm going to be honest here. I used to work for tmo in the past and I sold phones on Craigslist, **** ton of them. I was the #1 rep in my district for a very long time and I had new devices falling out of my ass lol. I won so many phones from HTC, moto, Nokia, Samsung, blackberry etc I didn't know what to do with them. Before tmo changed up everything I think I won 2 or 3 phones a month. They said we couldn't sell them but what the hell else were I supposed to do with all these smartphones? Was I wrong? probably. Did I care? Ehh not really I was young and just saw this $_$. The moral of the story is either hes winning them in contest/drawings or has stealing them and others are in on it. I wouldn't get involved though let sprint etc catch em!

Got my Amaze for ~ $130, no rebate

I called T-Mobile and asked for retentions and told them I needed a good deal on the Amaze without a rebate. They gave it to me for ~ $250 w/ tax, no rebate, waived shipping charges, and gave me a $120 statement credit (about one month of service on my family plan). It pays to ask!
They also told me I could keep my $25/mo 5GB 3G data plan, but I see on the website that I now have the $30 data plan. I'll complain but I doubt I'll get very far on that one...
I'm really excited about replacing my N1!

Call them and complain how your phone is a piece of sh*t and how it reboots itself and what not. Threaten to go to another carrier because their flagship phones kicks T-Mobile's phones ass and you don't mind paying the ETF (Early Termination Fee / Cancellation Fee). They'll transfer you to Customer Loyalty. Tell them your phone sucks and you will go to another carrier. They'll give you an awesome discount on the phone.

Smh if you were an employee I'm glad your not anymore. Thats not the right way to go about getting a deal guys, customer loyalty is great if your contract is close to ending because we will do the most we can to help you 6 months or less is best and its more helpful when you have more then one line because we can use more things to give you a better deal. You don't have to be pissed off or have an issue with your phone, you are a benefit to the company and we are there to help you anyway we can, and don't be surprised if we can't beat deals from costco, walmart, wirefly a lot of times on single lines sometimes even just on family plans they have real good deals.

I actually got a similar deal. bought one amaze from T-mobile (in november) for $250 and they gave me the second free. Basically I got each for around $125.

I honestly don't feel that it takes any tricks or lying and threats.
I've been with Tmobile for 7 years and I've upgrade plenty of phones either free or at a discount.
The only thing you need to do is be polite and be patient.
I've always found the reps willing to go the distance as long as I'm patient and as long as I have the nerve to ask.
Don't be afraid to ask for an upgrade.
Don't be afraid to ask for a different phone when you do a warranty exchange.
9 out of 10 times they won't make you an offer on their own.
And this leads people to believe that they should threaten to cancel or complain and throw a fit to get these deals the reps don't offer.
First off, that just makes you look childish.
And who knows if they make a note of that on your account or not?
I just ask them when I want something. If that rep can't help me they'll pass me along the CoC or I call back. No biggie.
Try it, give them a call and say
"Hey...so I just saw this new phone that I really want to get but I don't qualify for an upgrade yet...is there anything you guys can do for me?"
I have four voice lines and a MBB line. I've never had an issue getting a (slightly) early upgrade or some kind of deal. I always treat CSRs the same way I like to be treated (kindly, with respect and patience). I've gotten really good deals with T-Mobile.

[Q] Worth the upgrade from thunderbolt or wait?

I'm able to upgrade from my Thunderbolt to the Rezound for $99 (I can't seem to stomach the 2-yr contract even at that price!). I like my Thunderbolt but I have the itch to upgrade.... I can probably even sell my Thunderbolt on Ebay and make $100 lol. Anybody coming from a Thunderbolt wishing they stuck with the Thunderbolt and waited for a quad-core?
It's head and shoulders better than the Thunderbolt, but you may as well wait. With only two-year contracts these days it's worth the wait.
I've owned both, and I love my Rezound, but I got it as a replacement. I wouldn't have bothered otherwise.

How did you manage to get it as a replacement?! I am on my 3rd replacement for the thunderbolt and they absolutely refuse to give me anything else.

It was kind of a mess, and it took a week of ****ing up customer service, executive customer service, and some nasty emails. I don't recommend it.
Did you get your TBolt on a one-year contract? That's probably the problem. They told me they pretty much wouldn't give someone who was about to be off-contract a new phone. They eventually did, but it was awful.

Exactly the problem. I paid extra for a one-year contract so they told me the same thing: We can't change your phone if you are able to upgrade. I am more than happy to go through the process if it means me not having to be in a stupid 2 year contract lol
Here's the best question...what would you be waiting for? All of the announced HTC phones aren't for CDMA carriers. Who knows when the next crop of phones would be hitting and what they would be.

There will be an HTC One on Verizon soon enough. The MSM8960 SOC supports CDMA and LTE.

rumored HTC fireball is CDMA and modeled ADR6410 which would be a successor to the Thunderbolt. If it's quad-core and coming in the next 4-6 months it may be the way to go...

I was only able to because a CS agent ****ed up. Or, rather, did their job, and Verizon claimed they ****ed up, and so I appealed to a higher power.
A Verizon CS promised me a Rezound as a replacement, said it was in the mail, blah blah blah. I called a few hours later when I realized I wasn't sure if had included a battery and back in the package. The nice lady I talked to saw the order for the Rezound and no order for a battery and a backplate. So she ordered that and sent it to me.
Two days later I get two packages. One with the Rezound battery backplate and battery, and one with a Thunderbolt. One of those wtf moments. So I called in, asked what happened, and after hours on the phone they finally determined that the original CS agent was not authorized to give me a Rezound, and so the order had been cancelled, and they just sent me another Thunderbolt, all without telling me. All the while they gave me at least three or four different reasons, the first being that they had never ordered me a Rezound in the first place. So I asked the obvious question of, so why did I get a Rezound battery and backplate?
In the end they wouldn't budge. Only a Thunderbolt for me. No Rezound possible, despite them promising one to me.
I was kinda pissed, so I wrote executive CS an email detailing the situation. They called me, sorted the story out, and shipped me a Rezound.
I think the only reason I got a Rezound was because of their enormous series of ****ups. Without that they probably would have given me the same brush off they gave you. Well, they tried to give it to me. I'm not sure you'll have any luck--my situation was pretty particular.
Ironically I have a very similar issue. The customer service rep lied to me and said there is no other 4G HTC that is any better than mine so my option was to downgrade to a 3G HTC or take another Thunderbolt. I said "what about the rezound?". He told me the screen size was bigger on the Rezound so that is not possible. I responded by correcting him about the size. He said, "Ok fine, I will try to ship you the Rezound and you may have it by Tuesday but it will probably get denied. I will call you tomorrow if that happens". Sure enough, I was on the phone with his supervisor the next day because he never called me (shocker). They basically told me to pound sand in nice words. Eh whatever...

That's weird to me. Because if you're able to upgrade then your contract is coming close to being up and you would be free to go to another carrier. A long time ago on Sprint or Cingular my phone broke when my contract was over and they said they didn't want to give me one for free (I had no insurance or anything) but at the same time they were unable to diagnose what the problem was since it couldn't turn on. So I told them if you can't tell me what's wrong with it and you won't replace it I'll just go get a free phone from another carrier. Within 5 minutes they were giving me a phone. They offered me a particular one and I asked about a different one that was the same price and they let me have that. This was in flip phone days, still it was $100 price on phone.

I'm able to cancel in June... Verizon allows you to upgrade 4 months ahead of contract renewal.
It probably depends on your usage habits. My wife has a year left with the TB, but it's a great phone for her. The Rezound screen and camera are leaps and bounds better, but the battery life and overheating issues make me hesitant to say its a substantially better device.
If you are a power user who will really appreciate the screen and speed, upgrade. Otherwise wait for the next batch of phones that we're sure to see late summer or so. May as well stay on the cutting edge if you have the option!

Don't take this as a wiseass commnent or anything but...Doesn't the Rezound have GSM hardware? When (other than the iPhone) has a manufacturer retrofitted a phone to work on Verizon?
From my experience and other's, they will pretty much only bulge ONLY if you are still a year or so ahead from the contract being done. People where able to upgrade from a Droid Charge to other 4G devices, same with the Bionic. Im getting my wife her 3rd Droid Charge replacement, it keeps dropping 4G like there's no tomorrow whereas my Rezound is perfectly fine. One more complaint and they guranteed me a different 4G phone.
From reading a bunch of other similar posts like mine, I think I'm gonna make the jump. @ $99 for such a powerful device, I'd probably be crazy for passing it up when it very recently came out

I agree, I do have a feeling the Rezound will stay the best HTC phone on Verizon until the summer and even then still stay relevant.
Don't tell that to Verizon, they did a piss poor job of marketing the phone.

[Q] Any discounts available for a new customer?

I am thinking about coming to Verizon. I am on Sprint now with 2 lines with data on both. Because of a recent billing change I can get out of my contract until Saturday, March 10th. Sprint has went downhill in my area over the past year or so, but their prices are still good. I am looking to get a discount of some sort to help deal with the price difference. I will be getting 2 smartphones with data (likely used month to month at first until newer phones come out). I work for a small electrical contractor in a small town so I won't be eligible for a employee discount. Is there any tricks I can use to get a discount? Maybe somebody else's work email or something like that? If anybody knows anything please post or PM me with details/ link to thread/ anything. Thanks
I don't plan on signing a contract immediately because I would like to wait on HTC's next big phone. I have had the Evo3d since launch day and am a smartphone junky, so I don't think I could handle such similar phones for almost 3 consecutive years with no upgrade. I would like to go ahead and sign a contract now, use a used phone in the meantime and have an upgrade waiting on me when I get ready to use it, but the customer sales rep for Verizon said that wasnt possible. If anybody has any input, info, or advice please help me out. I have to swap carriers and get my 2 numbers ported before the end of the day Saturday, or I'm stuck with Sprint for another 14-16 months...That would be AWEFUL!

Can't you terminate your contract with sprint, but just stay on month to month without the contract?
getting discounts here isnt as easy as it was on sprint. i came from sprint, all you needed was an email and you were set. here they want proof of employment or if they use email, they send confirmation to that email from what ive seen. not to your own email. but those are few companies that do that so its harder. lol

No.. What they do is waive the ETFs AFTER you've ported out in a case like this.
Trust me.. they more than pushed me out last month with their attitude about the whole thing.
Sprint did indeed go downhill and while it is cheaper and truly unlimited.. you AREN'T getting what you're paying for anymore. VZWs 3G speeds blow away sprints and let's not even talk about 4G because it's night and day too. Sprint isn't even going to expand their current 4G network (wimax) because of the soured relationship with Clear. Oh and by the way... my 4G works just as fast indoors as it does outdoors. After 9 years with sprint that contract change was the final straw.
Make sure you get in during the double data deal because i'm not sure i would be comfy with a 2GB monthly cap.

unfortunately not. The guy I talked to said I have to be off the network completely by March 10th or I am stuck for the remainder of my contact. I have read that a few were allowed to go month to month and many that had 30 days after they called, but the rep told me it is 30 days from the February billing cycle. I just found out about this today and called right after work. So I have basically 3 days to have my numbers ported over to Verizon or I am out of luck.
Anybody have an account with no discount for 2 lines, 700 minutes, unlimited text, and 2gb(4gb under promotion) on both? If so what does it end up being after all taxes, surcharges, etc? I pay $167.XX on Sprint right now, and really hope Verizon can keep it under $200.
What if you port to att or verizon off contract? Then just port the number back to sprint off contract.

Somehow I think that would be a nightmare-ish idea.. especially if the OP needs his line for work.
If you need to port that quick you'll also need to do an in-store purchase. I think $167 for the package you stated is probably close to doable. You'll also get much more friendly/helpful customer service with verizon. Playing devil's advocate you should also be aware that verizon's mobile to mobile only includes other VZW customers unlike sprints any mobile to mobile.

That sound very tempting to try, but just sounds risky. I know I have read somewhere that if you cancel your contract on Sprint and come back within 30 days that you basically are just on your same old contract again. I maybe wrong, or whoever said it may have been wrong, I don't remember where I read it. But if someone has experience doing something like this I would love to here about it. It would at least get me through until HTC releases a quad core, or s4 based phone.

If you like HTC phones like i do.. just compare the specs of the verizon phones to the sprint phones (htc->htc). You'll see that verizon has much better specs on the phones than sprint too.

The on network mobile to mobile is now problem, because 90% of the people around here have Verizon anyway. The package I put together online was about $173 (before taxes and surcharges) , but I think I had insurance for 2 rezounds for that price.

I have to disagree. My Evo3d is very similar to my coworker's rezound . It has basically the same processor only .3ghz slower, same amount or RAM, same screen size, QHD screen vs 720p (the difference is honestly not noticeable when held side by side) and it came out about 4 months before. Don't get me wrong I really like the Rezound, but I feel it hardly has much better specs, slightly better specs at most.
That's what originally drew me to Sprint, they get the hottest phones first, and low monthly costs. But their service has let me down recently.

Well if it's close.. I would say to you exactly what I told my wife when I dropped Sprint. Sprint has done NOTHING to keep my account. They have not done anything with their local infrastructure. They never respond to trouble tickets. Their status quo really sucked bad.
Verizon on the other hand, has done extensive network upgrades and is very responsive to any problem you have.

Buying ebay phones?

I have to wait a little while until my current contract with Sprint is up before getting the Evo LTE. But I see them on ebay for about the same money as one would cost me in the store once I'm upgrade elegible. I'm wondering how the ebay phone process works to get it working on the Sprint network? I've only bought phones from Sprint and BB in the past. I know I need a clean ESN, but what I'm wondering is about activation and insurance. Does it cost me money to activate an ebay phone or can I just do it through the website tools? Is it possible to get insurance for the phone (aftermarket I'd assume)? If so, who do you recommend? Anything else to know about getting it working?

no it doesnt...if you have the phone just call sprint and ask them to activate the phone and theyll ask you for the serial number and such and activate it in a few mins and your good to go with a new evo and still out of contract
not sure about the insurance but there are places that sell insurance that you can buy i just dont know of them

just tell them to turn on the insurance when you activate or they will "forget" to say anything. I bought an OG EVO from e-bay as long as the seller is reputable you will be ok.
I think that technically there's an activation fee, but from what I've seen before it's not that hard to bypass. If you're finding a phone on ebay that costs the same as the subsidized price, then I'd think very hard about what I was doing. These phones are normally 2-4x the price you pay when you get a subsidy; you're putting yourself up for some real risk if an unsubsidized phone costs as little as a subsidized new phone.
If you do buy it though and it does turn out to be a clean ESN/MEID, then first off congrats since you just dodged a massive bullet and saved tons of money, but also go and sign up for TEP, at least for a few months. The only reason I recommend this is because I'm still not 100% sure that the great deal you got is without a hidden problem that could jump out at you and eat your savings.

Activation fee is charged on a new line or upgrade...not an ESN swap
Plus one for hidden issues/bad ESN.
I would seriously question an EVO on the second hand market for $200-300

We're definitely on the same page as far as second-hand devices go. That said, I would love clarification on the fee for hidden issues. It's not something I've ever heard of. I'm not discounting it as a falsehood by any means, I really am just very surprised to see such a thing and would love details. Screenshots work best IMO.
I've seen them go for 300-350 but less than that is a bad phone

There are a lot of these phones on ebay for under $250 right now. I figure $250 is about the break even point when I include the activiation fee and almot 10% sales tax we pay around here. I can't imagine they are all scams. I appreciate the concern, though.

you can totally get TEP from sprint on a phone you did not buy from them, I have got it on the last phone I bought. I just asked and they turned it on, it was that simple.

I look at Craigslist and Ebay almost daily to see what they're selling for. I have one and also the GSIII. One must go soon and if its the EVO, I don't think I'll get more than $300 for it. Some are selling brand new EVO's, well suppose to be, for $250 on CL. My opinion, which means nothing, thinks that maybe the EVO has a bad reputation right now from the people that swapped them out for the GSIII. Not sure.
Seems like the S3's are going for much more money. Could be it's because they work for every carrier?

S3's are offered by all 4 but do not have interchangeability . A sprint s3 will not work on Att etc.
It's more of a Flagship, heavily advertised phone that more people want. Simply supply vs demand

I bought new evo lte from ebay seller. When I called sprint to activate on my line the agent even asked do you want to keep TEP and I said yes. No problem at all and it is there looking on sprint's website in my profile.

i have bot multiple phones/devices on e-bay. have not had any issues with activation.
one time i bricked a device and the guy i originally bot it from was able to fix it for a small fee.
The activation fee is only on new phones. It is only when the esn is first activated on sprint. So if I bought a new phone and activated the esn but left it new in box and then sold it to you there'd be no activation fee as the esn was already in sprints system
