[Q] class action law suit against apple. - Sprint HTC EVO 4G LTE

I think we should file a suit against apple for patent and judicial system abuse. Their weak patents and ridiculous lawsuits are costing us dearly. Their ridiculous patents are delaying our phones. They are new to this game and don't have right to be such a holes. Anyone here an attorney and willing to put these rich pricks in their place?

personally.. this isn't worth the $5.05 ill get in the mail from apple.. You'll never get as much as you hope and dream for..

Dude a slight delay in your brand spanking new phone isn't a cause of action. It's not like you don't already have one. Good luck demonstrating economic or even any loss at all.

Two parties does not equal class action, but you are right, they may have a claim. However, Apple appears to be acting in good faith (ie. protecting their patents) so it would be hard to prove that they did this purely out of malice or a motivation to interfere.

This is why corporate crime should be policed just as heavily as personal. There was clearly a crime committed here, and the U.S. Government was their weapon. How malice and messed up is that? News of this comes to a company on the day it's launch phones are in the mail? Apples pockets are deep, I guarantee they knew what they were doing. If it looks like s.... smells like s.... and tastes like s.... it probably is s....
And here sprint fronts the bill, when they shouldn't have to and buys everyone who waited a case.

Again - I don't think your seeing the legitimacy of Apple's claim. I'm not saying it was right, or that they are right. In the eyes of the law, they do have the right to make that claim and enforce it through legal action. Now the real issue comes down to whether or not Apple is hindering HTC's business purely to mess with them. I don't think that is the case - it would cost millions of dollars to enforce such a claim with absolutely no guarantee of success. Yes that is a drop in the bucket, but justifying that kind of legal expense has to occur on someone's budget.
It would be up to HTC's counter-claim (if successful) to prove more likely than not - whether Apple's action was purely obstructive. The law will always look at the evidence in the light most favorable to the person being sued (similar to the concept of jurisprudence), and in the case of a counter-claim that would be Apple.
HTC's claim of obstruction would have to be clearly egregious in order for it to be sustained in court (likewise, Apple's claim of infringement). For those of you who have a problem with this - pray that you never become a defendant in any court matter.

Guys, lets think clearly for a minute- please.
Apple believes that they have a patent that HTC has infringed upon. They take proper action and bring their claim in font of the International Trade Commission. The ITC then sides with them! How Apple can somehow be responsible for intentionally causing damage to a potential "class" for the above actions is beyond me.
Anyway, lets continue for the purpose of illustrating the absurdity of Apple being sued.
The ITC judge tells HTC that they need to remove the features from the phone that Apple holds patents for. HTC agrees. Then, subsequently HTC comes back and states that they don't feel they need to remove the core functionality, as they have found a way to code around the patent. Whether or not this had any impact on the delay itself, I don't know but it could have.
Even if somehow, the ultimate conspiracy theorist was able to prove Apple somehow had done all of this purposefully, Apples claims are still 100% valid.
I do believe that the guys in Cupertino got a huge rise out of this, I am sure they were laughing their asses off. However, from their perspective this is just a fortunate side effect of a completely legitimate claim that was being enforced by an International body and not Apple themselves.

All I know is because of this Apple lawsuit my youtube links open in a browser and not an app.

Tried this on my Evo 3D (because the ICS ROM also ships with this) and unfortunately it doesn't work =( once I clear defaults and I try to tap on a YouTube link, nothing happens.
I suggest people try it on the Evo LTE, maybe it works there because I have Sense 3.6, perhaps and hopefully it works different on 4.0.

Haha, I share your pain, I too feel slighted by this recent fiasco. However, as stated already, there is no "class action" suit to be had. So what are we left to do, what can we the mere lowely consumers do? Don't buy Apple. Simple.
Maybe after you and I recieve our phones, we "show off" our phones to those we know that own an iPhone. Perhaps we do our best to promote the Android platform. Explain the inherent superiority of open source. Demonstrate the overwhelming edge we have in capabilities, & customization abilities.
The sad fact is, Apple has the lions share of the market, extremely deep pockets, and apparently the ear of some influential higher-ups. Not to mention the mindless fan boy, status symbol toting majority of iPhone users that will buy an iPhone regardless of what may come along, just because it's an iPhone.
But take heart my Android loving friends. How long has it been since Apple has had a revolutionary idea they brought to the table? When did their business strategy go from marketing to desperate/frivolous patent infringement claims? How far behind the curve are they?
Go take your shiny new phone and compare it to a new IP4S, what do you notice? Sad isn't it? It's a matter of time. Open source platform IS the future. Apples closed source, "we own that idea" mentality WILL be it's downfall. Might take five years, could be twenty, mark my words, Apple is headed for decline, and they know it.

This. It's just that up until recently they were neither big enough nor relevant enough to matter. Jobs is just being jobs as always... Unfortunately now he has the money and influence to be more than a just a sideshow to the technology industry... A zany footnote in computer history..... Considering Apple, Inc. was on the verge of folding just a few short years ago, I'm really surprised by the turn that Apple's made.

Every company forgets where they were and how far they've come. Take HTC as an example; they just about did it. They went from a company that embraced the developers and then, in a few short years, turned around and locked down their bootloaders.
Without social media outlets such as facebook, I highly doubt they would have reversed their decision to maintain locked bootloaders.
Apple needs the same kind of treatment to be reminded that the mass majority of users out there do not support their products (Android phones are outselling the iPhone, Android tablets have eaten into almost a third of the iPad market, and Macs still don't have nearly the same level of market penetration into the desktop/laptop sectors).

Uhh, yeah. Good luck with that. While I agree whole heartedly apple fans are nowhere near as brand agnostic as, well, anyone else. Drank the koolaide, etc etc etc.
In a recent poll of 4000 consumers 35% said they wanted an iphone 5, even knowing nothing about it.

How hasn't iOS5 infringed on patents that Google owns? More specifically - why hasn't Google's patented and pioneered notification pulldown, and overall display using a curtain, been pursued in court?

Google doesn't own Android patents other than the Market and some other apps. Android is an open-source project. The notification system in Android is not patented...but it may well become patented...by Apple now.

That was the term "Multi-touch". Apple wanted to copyright it. The term was determined to be too widespread and common to become a copyrighted name. Apple does own the patent on mobile capacitive multi-touch display tech, though.

Money.
If you can make your product the only one available on the market then you get the whole pie.
Think about it, if the only smartphone was the iphone, we'd all have one, most likely jailbroken etc to be useful, but Apple would have had their money from us for it.
Even if you can stop one company's product for a few weeks you weaken them and will increase your sales by reducing consumer choice.
The information technology patent wars are completely out of hand. This would be a terrible development, if Google brought Apple to court on something silly like the "curtain" UI feature.

I wouldn't be surprised if Apple DID patent it, ESPECIALLY now that the patent is issued to the "first to submit" rather than the "first to invent." To be fair, it's my impression that the "first to invent" standard was pretty hard to enforce.
But nonetheless with the patent process streamlined and less rigorous, the primary change will be that patent trolls and giant corporations will have an easier time making frivolous patents which hurt innovation rather than encourage it.
In conclusion... I'm voting for Colbert 2012.

Apples issue is that they have enough money to buy their patents. Most of them are so vague they have clearly just paid off the patent office to issue it. I mean seriously, i'm sure one of their patent was for using icons to launch applications, like they were the first to ever use that!
They just seem to pump money endlessly at anything. Did you know that iCloud is actually a business name, and apple have just decided that they want the name, forget about copyrights. The whole system was set up to protect the little companies, now the big companies are using it as a weapon. Why don't they just invent new technology rather than patenting other peoples technology then blocking sales of it.
Microsoft are just as bad, they get through tough times by exploiting patents and having a rather large income from android sales alone, it was recently estimated to be somewhere around $300,000,000 just in royalties for software they didn't invent.
What's next, Apple have patented the act of suing someone over patents?
I think we'd all be happier if they spend their legal fees in R&D rather than just attacking each other, it's clearly not customer or product focused anymore!

In a way I think the article makes sense because remember when the S2 came out Apple was trying to block its sales world wide because it had a "rectangular shape", which I don't know wth they want phones to be then. So in order for the S3 not go through that they probably went with this shape for the phone (like Galaxy Nexus). Anyways in my eyes it has a nice shape.
If this is correct, and customers are receiving a poorer product because of Apple's insanity, I personally think this authorizes physical violence towards apple customers (including iTMS customers) for funding a cartel.
This company needs to be stopped, and the only way this is happening is by choking off their income.
I don't understand how the "fruit company" can get away with blocking a phone because it has a rectangular shape, especially as there had been rectangular shaped phones before. Its like one car manufacturer blocking another car manufacturers vehicle because it has 4 wheels.
It seems to be that the "fruit company" can't face competition from anyone else. Perhaps this is because they are aware of the fact that their market share is decreasing?
Reading the article - it kinda make sense what the author says about the S3 design having to change in order to keep Apple happy based on the fact that Apple wanted to sue them no so long ago. I do wonder how long it will be before they find some fault with the S3 and try to block the sales of it.

No need to get violent with Apple users (I'm one of them ).
If Samsung really want to hurt Apple, all they have to do is stop supplying Apple with components for their IOS and mac computers. Apple will never be able to keep up with demand without Samsung parts in their iphone and ipad. But it's not likely to happen as both Samsung and Apple make billions off each other.

As you correctly surmise, there's no reason Samsung would want to hurt Apple - they sell their components for billions. But there is a reason the consumer would want to do so (though it'd likely be just out of futile vengeance). After all, it's the consumer who's hurt by Apple's anti-competitive strategies: they get less choice, they have to fund the lawsuits, and (depending on whom you ask) they get ugly phones due to their sheer ridiculousness.
This is even true of Apple consumers like yourself: your money is effectively funding Apple's crusade to force everyone else out of the market. Forcing competitors off the market does not help you; it only helps Apple. (Indeed, as competition is the driving force behind lower prices and increased innovation, it, in the long run, hurts you as well.)
The design is not bad I think its quite good however the material used is unforgivable.

This is one of many reasons why I WON'T buy an iPhone. It's seriously getting to the point that I want to write a letter to the courts and voice my opinion.

Unfortunately, I own an iPad (as is obvious from my signature). At the time it came out there were (in my opinion, so please don't post "WHAT ABOUT THE XXXX??!!") no comparable Android tablets. Also unfortunately I can't justify buying another tablet based on my dislike (now bordering on, sigh, hate) of Apple. I only use my iPad for browsing, Kindle app, streaming video and music (that I didn't buy from iTunes) from my HTPC, and Netflix. So the sum total of money Apple made off me is from the hardware. And that won't be happening again anytime soon.

I also unfortunately have the new iPad, but only because it was a gift for my college graduation/birthday. I mean I'm not going to turn down a great tablet, but I've bought maybe two apps and not planing on buying anymore, and one of them was a game I had already bought on Android. I only use it for web browsing really, I wish I could root it lol but I still hate Apple.

There was a comment on the article that someone made that they contacted Sprint about the delay on the Evo 4G LTE and they said that the delivery date will still be the 17th/18th. So it might have just been a particular shipment but it seems those who preordered will be getting it
I had no intention of buying the Evo LTE, but this really pisses me off.
Someone needs to address this broken patent system. And every single one if Apple's patents should be reviewed by someone who is not on Apple's payroll and is actually qualified for the task at hand.
This is beyond frustrating. It's time sure google to start defending their OS.

I heard that they're already shipping too. It's because they would have already had the initial rollout within the country. It's after that shipment that we will see shortages.

Most of the iPhone and Mac users I know bought Apple products to be different from the masses and avoid greedy corporate conglomerates (ala Microsoft). Ironic how Apple has become the very beast that they sought to avoid.
On a side note, Apple's vague software patents should be nullified. Software patents in general are sketchy at best. Patent reform is greatly needed....technology innovation and choice will suffer greatly if something isn't done.

Sure, it sucks for Samsung. But a lot of what Apple went after them for at least made a little sense. Samsung blatantly copied Apple in many situations. And even if there were examples of prior technology that fit the case, Apple was able to show that Samsung intentionally copied Apple's work instead of basing work off of said prior technology.
Before we start a circlejerk of people condemning Apple and all of its employees to hell, please realize that this was a legitimate legal decision and the people who made this decision put a lot of thought into it. I'm not happy that Samsung lost either, but I also believe that they lost for a reason.

This major win with a major competitor will only give birth to a whole new round of suits and new strategy that will probably lead to us being phucked over. The realization of apple being a monopoly is becoming ever more true. You think the bs we had to put up with when our EVOs were held in customs was crap, just wait. I see bad things heading our way. I know Samsung copied apple. We all said that awhile ago. But jeez, if the courts will agree with apple that a rectangle with rounded corners is copying, then what does that say for us?

If I was running apples legal department I would Sue Samsung also they are tearing there sales apart all apple needs to do to dominate the market again is make more choices for there phone bigger screens easy hacking and better ui improvements come on apple dust off those thinking caps and make a new product instead of pumping out the same phone every year.

Ha.. A billion dollars. Should be able to pay their lawyers with that.
It's not like Apple is going to be able to go willy nilly on other OEMs now. They don't have the resources for that, and if they keep it up, Google will eventually step in.

As much as I love Android, I kind of have to agree that some of the devices that Samsung were making did look like iFails. Hell, I think Touchwiz does. I will say though, that Apple suing anyone for stealing ideas when they themselves have done so repeatedly in the past is just bs.
Here's the break down of what was infringed. Placement of home button? Thin frame with rounded corners? Serious!? I'm no Samsung fan, but for the sake of our future of android devices I was rooting for Sammy.

Like I.said..that's the scary part..they went to court with these bs patents and they won..now every phone that has those traits can be targeted..this is just the beggning im afraid..esp when its prob difficult to find a jury that isn't a iPhone or android user ..and its the patent that's the issue..once granted the court will uphold their decision..that's where reform needs to begin
I wouldn't worry. This will probably be overturned. A lot of mistakes by the jury.
